Suit Deepens Divide between KS Lawmakers, Judiciary

Statehouse 3 - small(Photo by Stephen Koranda) A school funding lawsuit has deepened a divide between the judicial branch and some lawmakers. The Kansas Legislature is awaiting a decision from the state Supreme Court that could affect education funding. The case argues that the state should increase the amount of money it spends on education. During the State of the State address earlier this month, Governor Sam Brownback said the Legislature should make decisions about school funding, not the judiciary.

Justices have not explicitly responded to Brownback, but in the recent State of the Judiciary address, Chief Justice Lawton Nuss said the courts work to fairly and impartially apply the law.

A lower court ruled last year that the state isn’t adequately funding education.
